Terms and Conditions
This is a legal agreement between you and ChristianCrush.com LLC (the "Site"), who can be contacted at 613 Walnut St. Boulder, CO 80302. By using this Site and services you agree to and are bound to all of the following terms and conditions specified below. Additionally, by using the Site, you represent and warrant that you have the right, authority and capacity to enter into this agreement and to abide by all the terms and conditions of this agreement.
These terms and conditions are an electronic contract. If you would prefer to receive a paper copy of the contract please send a self addressed envelope to the address above. This agreement is subject to change at any time and your continual use of this Site and services indicates your endorsement of any possible changes. It is your responsibility to check these Terms and Conditions periodically for any changes.
Eligibility
By using this Site, you agree to the following:
- I am at least 18 years of age.
- I will not post any sexual content, nudity, or sexually explicit material of any type.
- I will not post any content or messages that are obscene, racist, profane, or abusive in any way.
- I will not post any form of illegal content or information.
- I will not harass other members emotionally or sexually.
- I will not post or submit any type of copyrighted material of any kind without receiving prior written consent.
- I will not advertise or solicit any products or services to other members.
- I will not use any personal identifying information in my username or profile, including my last name, phone number, personal email address, street address, etc.
- I will not falsify any information in my profile, including marital status.
- I do not have a criminal background and I am not required to register as a sex offender anywhere.
- I will not use any technology, design, or content within the ChristianCrush.com website without first obtaining written consent.
- I will promptly notify ChristianCrush.com of any violations of this agreement by anyone, including but not limited to, members.
By using the Site and becoming a member you agree to the above rules of use and warrant that you are eligible for membership based on these rules. If you do not agree with anything in this agreement or are not eligible under the restrictions above then do not use this Site or any of its services.
Membership Billing
ChristianCrush.com currently offers free Christian dating services. At this time, there is no charge for use of this Site but this may change at some point in the future.
Account Security
We have extensive security measures in place to protect the loss, misuse and alteration of the information stored in our database. These measures include but are not limited to:
- Member passwords and all member information are stored encrypted in the database.
- Network is protected by firewalls and monitored real-time for any intrusion.
- Server software is kept updated to address any security vulnerability found.
- Servers are kept in an enterprise level security facility with key-card access and video monitoring.
ChristianCrush.com will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure.
Limitation of Liability
ChristianCrush.com does not screen its members and is not responsible for content submitted to the Site or for information provided by members in their profiles. ChristianCrush.com is not responsible for the dating experience or the conduct of its members. Although ChristianCrush.com attempts to minimize and eliminate such content, you understand that by using the Site you may be exposed to content that you may find offensive, indecent or objectionable and that, in this respect, you use the Site at your own risk. ChristianCrush.com is not liable for the compatibility of its members or any negative ramifications from communication or interaction between members, such as emotional distress, bodily injury, or other types of damage.
Except where prohibited by law, in no event will ChristianCrush.com be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if ChristianCrush.com has been advised of the possibility of such damages.
If, notwithstanding the other provisions of these Terms and Conditions, ChristianCrush.com is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any content, ChristianCrush.com's liability shall in no event exceed the greater of (1) the total of any subscription or similar fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against ChristianCrush.com or (2) US$100.00. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
Indemnification
You agree to indemnify and hold ChristianCrush.com, its officers, directors, shareholders, successors in interest, employees, agents, and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys' fees), made against ChristianCrush.com by any third party due to or arising out of or in connection with your use of the Site.
Termination
You agree that ChristianCrush.com may, in its sole discretion and without prior notice, terminate your account with ChristianCrush.com and/or block your future access to the Site if we determine that you have violated these Terms and Conditions or any other guidelines which may be associated with your use of the Site. In the event that ChristianCrush.com terminates your account for violation of this agreement, you will not be entitled to a refund of any membership fees. ChristianCrush.com also has the right to monitor any and all communication conducted on or through the Site. ChristianCrush.com has the right, but shall have no obligation, to remove any information posted on the Site or by its members that, in the sole discretion of ChristianCrush.com, violates the above terms and conditions.
Disclosure of Information
ChristianCrush.com reserves the right to disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury, abuse to or interference with (either intentionally or unintentionally) the rights or property of visitors to or users of the Site, including ChristianCrush.com's members or ChristianCrush.com's rights or property. ChristianCrush.com reserves the right at all times to disclose any information that ChristianCrush.com deems necessary to comply with any applicable law, regulation, legal process, governmental request or to protect someone's health or safety, such as when harm or violence against any person (including the member) is threatened.
Privacy Policy
With the exception of the aforementioned disclosure to law enforcement or in the event of a lawsuit ChristianCrush.com will not share any of your personal information with anyone or any other company.
Disclaimer of Warranty
ChristianCrush.com provides the services on an "as is" and "as available" basis and grants no warranties of any kind, whether express, implied, statutory or otherwise with respect to the services or the Site (including all information contained therein), including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. ChristianCrush.com does not warrant that your use of the services will be secure, uninterrupted, always available, error-free or will meet your requirements, or that any defects in the services will be corrected. ChristianCrush.com disclaims liability for, and no warranty is made with respect to, the connectivity and availability of the services. This section will apply to the maximum extent permitted by applicable law.
Controlling Law and Jurisdiction
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Colorado without regard to its conflicts of law provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Boulder County, Colorado, and waive any objection to such jurisdiction or venue.
General Provisions
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
You agree that, except as otherwise expressly provided in this agreement, there shall be no third-party beneficiaries to this agreement.
The failure of ChristianCrush.com to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision. This agreement contains the entire agreement between you and ChristianCrush.com regarding the use of the Site and the service and completely replaces any prior agreements between you and ChristianCrush.com in relation to the Site. If any provisions of this agreement are invalid, the remainder of this agreement shall continue in full force and effect.
